Modification of enactments.
persons formerly in that service;
(3) the payment of pensions or allowances at rates
prescribed by law or, where no rates are so
prescribed, at such rates as the Secretary of
State shall determine, to wives, children and
dependants of persons mentioned in the fore-
goingparagraph or, in special cases, other
persons resident or previously resident in
the Colony, in either case whether such
persons are living or not;'
(4) any other purposes of the Government of the
Colony:
Provided that nothing in this section shall authorise
the application of the capital moneys of the Exchange
Fund established by the Currency Ordinance, 1935, except
for purposes prescribed in that Ordinance as amended by
subsequent Ordinances or for the redemption of Hong Kong
currency.
(2) For the purposes of this section a person shall
be deemed to be a dependant of another person if the
Secretary of State is satisfied that he or she was
substantially dependant upon that other person for
support.
3. Save as otherwise expressly provided in this
Order all the functions of the Governor, the Governor in
Executive Council or any officer or authority of tho
Government of the Colony under the enactments mentioned
in the First Schedule to this Order shall be regarded as
transferred to and shall be exercisable by the Secretary
of State.
4. (1) The enactments mentioned in column 1 of the
Second Schedule to this Order shall have effect subject
to the modifications set out in column 2 of the said
Schedule.
